Terms & Conditions for users of Makerble
Makerble visualises the impact of your charitable donations so you understand the good you have done for the causes you care about.
By using our mobile app, Facebook page, ww.makerble.com or any other Makerble service (each a “Makerble Service”, together the “Makerble Services”), you are agreeing to be bound by the following Terms & Conditions.
The Makerble Services are provided to you by Make Worldwide Limited (“Makerble”).
What’s covered in these Terms & Conditions?
Use of Makerble Services
The Makerble Services are provided to you free of charge for your personal use subject to these Terms and Conditions. To register for any of the Makerble Services, you must be over thirteen years of age. You must ensure that the details provided by you on registration or at any time are correct and complete. Any use of the Makerble Services by people under the age of thirteen should be under the accompaniment of a responsible adult. You are advised to think carefully before publishing or sharing any personal details (address, telephone number, email or any other details which could be used to identify you) on any of the Makerble Services.
We may update these Terms and Conditions from time to time. When we do, we will indicate the date these Terms and Conditions were last updated. Please check them regularly.
Asking people to donate
Makerble is a place to change the world your way. It is an environment where people are free to support the causes they care about without being bombarded with new requests to give and give more. Therefore please do not abuse the Makerble communication features to request people you do not know to give to causes you care about. Makerble has the right to suspend terminate the account of people whom Makerble considers are abusing this feature.
Please do not use abusive or offensive language when using the Makerble Services. Use of abusive or offensive language will result in suspension or termination of your account.
Please do not upload indecent imagery such as child pornography, pornography or images containing nakedness. Failure to adhere to this may result in suspension or termination of your account.
All images, logos and text related to projects and charities on the Makerble Services are owned by Makerble or the organisations it is working with. Please contact Makerble if you wish to use the Makerble logo or any other intellectual property belonging to Makerble. Should you wish to use the intellectual property owned by the organisations, e.g. on external websites or on any other material or medium (printed, digital, video, TV, audio, broadcast), please obtain permission from the organisation owning the content directly. It is possible that the organisation will be happy for you to promote it but there may be situations where this is not the case.
As part of your use of the Makerble Services, you may submit content including questions, comments, suggestions, ideas, feedback or other information, text or images (“User Content”). We respect intellectual property rights. Therefore, you confirm that the User Content that you submit is your own original work, is not unlawful and does not violate or infringe anyone else’s rights (including privacy rights).
You retain ownership of any intellectual property rights that you hold in User Content submitted by you. However, you grant us and the organisations we work with a royalty-free, perpetual, irrevocable, non-exclusive sub-licensable licence to use, host, store, reproduce, modify, communicate, publish, publically perform, publically display and distribute such content in any media and allow others to use User Content which you submit in whole or in part or in any form.
When using the Makerble Services, you control your privacy. If you wish to remain anonymous as a donor, you can choose to do so. We respect your privacy. Aside from the information about you which is publicly accessible (your name, photograph, projects on your String, projects on your Wish List and your Recommended projects, friends, groups and any other user generated content, e.g. comments) we keep your details private.
We do not give charities your details unless you ask us to in your own Privacy Settings.
We do not sell, rent or even freely give your details to other parties, companies or individuals.
How donations on Makerble work
The CharitiesProjects on Makerble are run by charities registered by the Charity Commission in the UK. As Makerble develops, we may begin to include projects run by other organisations in the UK and from around the world.
The Donation Process
Makerble is a subscription service. We move your monthly donation around to crowd-fund different charity projects according to your donation mode.Donation modes:
1. Cherry-pick Projects mode
You choose the specific projects you want to donate to initially in the Change Store. Once those projects have been funded, Makerble will find similar projects for you to donate to.
2. Ready-made Collection of Projects mode
You choose a ready-made Collection of Projects to donate to. Your donation will fund projects that the Collection Owner adds to this Collection. Collections can be managed by companies, charities, other users or Makerble’s Editorial Team.
If you are a UK tax payer the government will, in certain circumstances, add a certain amount to your donation. At the moment, this is 25pence to your project(s) for every £1 you donate. Please check the HMRC website for more information and the current figures at the time of making your donation.
Makerble charges charities a Transaction Transparency fee equivalent to 4% of the donation. When Gift Aid is applied to a donation, the Makerble Fee is deducted from the Gift Aid amount added.
Makerble’s payment partners charge an online payment processing fee. At the time of writing these fees are as follows. Please check the payment providers’ websites for up to date fees.
Go Cardless Fee for donations made using direct debit: 1% of the donation Stripe Fee for donations made by credit and debit card: 2.4% of the donation plus 20pence
Makerble provides impact reporting tools to charities. We trust charities to publish accurate data but we are not liable if they publish data which is subsequently found to be inaccurate.
Termination of the Agreement
You have the right to terminate your account with Makerble at any time.
Makerble has the right to terminate its account with you at any time.
Password and security
When you register to use the Makerble Services you might be asked to create a password. You must keep this password confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password. If you know or suspect that someone else knows your password you should change it immediately.
If Makerble has reason to believe that there is likely to be a breach of security or misuse of the Makerble Services, we may require you to change your password or we may temporarily suspend your account.
The Makerble Services are provided by Makerble without any warranties or guarantees. To the fullest extent permissible by law, Makerble excludes all liability for loss or damage caused through the use of the Makerble Services.
The Makerble Services may provide content from other Internet sites or resources and while Makerble tries to ensure that material included on the Makerble Services is correct, reputable and of high quality, it cannot accept responsibility if this is not the case. Makerble will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Makerble Services. If Makerble is informed of any inaccuracies we will attempt to correct the inaccuracies as soon as we reasonably can.
In particular, we disclaim all liabilities in connection with the following:
- incompatibility of the Makerble Services with any of your equipment, software or telecommunications links
- technical problems including errors or interruptions of the Makerble Services
- unsuitability, unreliability or inaccuracy of the Makerble Services
- inadequacy of the Makerble Services to meet your requirements
While Makerble has taken steps to ensure that the charities using its service are operating above board – for example, we ensure that they are all registered with the UK Charity Commission, – Makerble will accept no liability if the charities, their staff members or representatives break the law or act fraudulently. Should Makerble discover that any charity is acting fraudulently, Makerble will endeavour to take reasonable steps to freeze any donations in transit, investigate and/or terminate the charity’s account as soon as it reasonably can. In the event that a charity’s donations are frozen in transit and the charity is found to have been acting fraudulently, Makerble reserves the right to distribute those donated funds to one or more charities on Makerble, if permitted by applicable law to do so.
To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to the Makerble Services.
The Makerble Services may be temporarily unavailable from time to time for maintenance or other reasons. Makerble assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user communications or donations. Makerble is not responsible for any technical malfunction or other problems of any telephone network or service, computer systems, servers or providers, computer or mobile phone equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any site or combination thereof, including injury or damage to user's or to any other person's computer, mobile phone, or other hardware or software, related to or resulting from using or downloading materials in connection with the Internet and/or in connection with the Makerble Services. Under no circumstances will Makerble be responsible for any loss or damage, including any loss or damage to any User Content or Third Party Applications, software or content posted on or through the Makerble Services or any interactions between users of the Makerble Services, whether online or offline.
Makerble reserves the right to change any and all content, software and other items used or contained in the Makerble Services at any time without notice. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof, or any affiliation therewith, by Makerble.
You may not use the Makerble Services for any of the following purposes:
- disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material
- transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice
- gaining unauthorised access to other computer systems
- interfering with any other person's use or enjoyment of the Makerble Services
- breaching any laws concerning the use of public telecommunications networks
- interfering or disrupting networks or web sites connected to the Makerble Services
- making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner
Makerble reserves the right to refuse to post material or to remove material already posted on the Makerble Services, but we do not actively monitor it.
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
any claim that the use of the Makerble Services by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice;
any claim that the use of the Makerble Services by you infringes that third party's copyright or other intellectual property rights of whatever nature; and
any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Makerble Services by you.
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
You may not assign, sub-license or otherwise transfer any of your rights under these Terms and Conditions.
If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
If you breach these Terms and Conditions and Makerble ignores this, Makerble will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.
Makerble shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its control.
A person who is not a party to these Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these Terms and Conditions but this shall not affect any right or remedy of a third party which exists or is available apart from that Act.
Third Party Websites
As a convenience to Makerble users, the Makerble Services may include links to other web sites or material which are beyond its control. Makerble is not responsible for content on the Internet or on any third party site.
We are keen to launch local Makerble Services internationally but until that time, Makerble makes no promise that materials on the Makerble Services are appropriate or available for use in locations outside the United Kingdom, and accessing the Makerble Services from territories where its contents are illegal or unlawful is prohibited. If you choose to access this site from locations outside the United Kingdom, you do so of your own initiative and are responsible for compliance with local laws.
